Terms and Conditions


Welcome to Mars Venus Dating, a service for adults to meet online (“Service”). To use our site you must, at a minimum, be registered as a profile holder (“Member”) and agree to the terms of this agreement (“Agreement”).

Any use of our Service after you have registered will constitute as acceptance of the terms of this Agreement. Mars Venus Dating may modify this Agreement from time to time, effective upon notice to you as a Member. Any use of our Service after such notice will constitute acceptance by you of such changes.

  • Eligibility. By registering, you represent and warrant that you are at least 18 years of age, you are not in a committed relationship by anyone’s definition, you are available to date, and have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. You further agree to be held responsible if any of these statements you make and agree to are determined to be untrue.
  • Term. This Agreement will remain in full force and effect while you use the site. Mars Venus Dating may terminate your access to the site and your membership for any reason at any time. Mars Venus Dating reserves the right in its sole discretion to remove profiles that are incomplete or that have been inactive for 90 days.
  • Screening. You have complete responsibility for screening those people you meet online. You are solely responsible for your interactions with others. You understand that Mars Venus Dating makes no guarantees, either express or implied, regarding your ultimate compatibility with anyone you meet through the Service or that any information contained in any profile is truthful. Mars Venus Dating reserves the right in its sole discretion to email profile holders for any purpose.
    • STATE OF NEW JERSEY RESIDENTS:  IN COMPLIANCE WITH THE INTERNET DATING SAFETY ACT (JANUARY 2008), MARS VENUS DATING DOES NOT PROVIDE BACKGROUND CHECKS (CRIMINAL OR OTHERWISE) ON ANY OF OUR PROFILE HOLDERS.
  • Exclusive Use. Your account is for your sole, personal use. You may not authorize others to use your account, and you may not assign or otherwise transfer your account to any other person or entity.
  • Non-Commercial Use. The site is for the personal use of individual Members only and may not be used in connection with any commercial endeavors. You may not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You will not transmit any chain letters, advertisements of products or services, or anything other that personal correspondence about yourself to other Members. You will not refer Members to other Web sites for any purpose until you have established a personal relationship with that individual.
  • Online Conduct. As a Member, you agree that:
    • You are solely responsible for any content you publish, display, or otherwise communicate in any manner on the Service, or transmit to others.
    • You will not post on the Service, or transmit to others, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity).
    • You will use the Service in a manner consistent with any and all applicable laws and regulations.
    • You will not provide inaccurate, misleading or false information to Mars Venus Dating or to any other Member. If information provided to Mars Venus Dating or another Member subsequently becomes inaccurate, misleading, or false, you will promptly notify Mars Venus Dating.
    • You may not include in your profile any telephone numbers, street addresses, last names, or email addresses.
    • Mars Venus Dating reserves the right, but has no obligation, to monitor the materials posted in the public areas of the Service. Mars Venus Dating shall have the right to remove any such material that in its sole opinion violates, or is alleged to violate, any applicable law or either the letter or spirit of this Agreement.
    • YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT OF THE MATERIALS YOU POST IN THE PUBLIC AREAS OF THE SERVICE AND IN YOUR PRIVATE EMAIL MESSAGES.
  • Copyright Policy. You will not post, copy, modify, transmit, show in public or private, create any derivative works from, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
  • Dealings with Advertisers. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such advertiser. You agree that Mars Venus Dating shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.
  • Confidentiality. You agree that –
    • With the exception of the information provided to other profile holders, Mars Venus Dating will keep confidential all information supplied to it by you, including credit card number(s) and other financial information, and shall use or disclose such information only for the purposes for which such information was collected, or as required by court order or applicable law.
    • By using our Service, you agree to allow us to anonymously use the information from you and your experiences to continue our research into successful relationships. However, all of your responses will be kept anonymous, and no personal identifying information will ever be published.
  • Warranties. You agree that –
    • MARS VENUS DATING PROVIDES THE SERVICE ON AN "AS-IS" BASIS AND GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE WITH RESPECT TO THE SERVICE.
    • MARS VENUS DATING SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
    • Mars Venus Dating does not warrant that your use of the Service will be secure, uninterrupted, always available, error-free, or will meet your requirements, or that any defects in the Service will be corrected. MARS VENUS DATING DISCLAIMS LIABILITY FOR, AND NO WARRANTY IS MADE WITH RESPECT TO, THE CONNECTIVITY AND AVAILABILITY OF THE SERVICE.
  • Limitation of liability. You agree that –
    • IN NO EVENT SHALL MARS VENUS DATING BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE SERVICE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OR CORRUPTION OF DATA OR PROGRAMS, SERVICE INTERRUPTIONS, AND PROCUREMENT OF SUBSTITUTE SERVICES, EVEN IF THE COMPANY KNOWS OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
    • UNDER NO CIRCUMSTANCES WILL MARS VENUS DATING’S AGGREGATE LIABILITY, ON ANY FORM OF ACTION WHATSOEVER IN CONNECTION WITH THIS AGREEMENT, EXCEED THE PRICE PAID BY YOU FOR YOUR ACCOUNT.
    • IN NO EVENT SHALL MARS VENUS DATING BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION, BODILY INJURY, EMOTIONAL DISTRESS, AND/OR ANY OTHER DAMAGES RESULTING FROM COMMUNICATIONS OR MEETINGS WITH OTHER MEMBERS OF THIS SERVICE OR PERSONS INTRODUCED TO YOU BY THIS SERVICE.
  • Indemnity by Profile Holder. You will indemnify and hold harmless Mars Venus Dating, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorneys' fees) relating to or arising out of your use of the Service, including any breach by you of the terms of this Agreement.
  • General Provisions. You agree that
    • This Agreement, accepted by you upon use of the site and further affirmed by creating a profile, contains the entire agreement between you and Mars Venus Dating. No change or amendment to this Agreement made by you shall be effective unless in writing and signed by a duly authorized executive of Mars Venus Dating.
    • California law (regardless of conflicts of law principles) shall govern this Agreement, and that any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the federal and state courts in the Southern District of California, other than for actions to enforce any order or judgment entered by such courts.
    • Unless otherwise explicitly stated, the terms will survive termination of your registration to the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
